shall be considered an agreement between Wisely Source Co. , Ltd. (hereinafter referred to as the “ Platform Provider”) provides services as a medium for finding / contacting and hiring freelancers . _Definition

In these Terms and Conditions of Use of the Platform, unless otherwise defined, the following terms shall have the meanings
set forth in these Definitions:
“ Platform” means the Fira World application .
“ Other Platform ” means any application , website or other digital channel that is not a Platform of Fira World which may be linked or used in conjunction with the Fira World platform to support the provision of services or facilitate users.
“ Platform Provider ” means Wisely Source Co. , Ltd.
“ Platform User ” means a person who accesses the Platform Services through the Fira World Application and / or Customer.
“ Customer ” means a person who uses the Platform to search for jobs, accept jobs, and receive work results through the Platform, including using various services. As specified by the platform
“ Independent Contractor ” means a person who posts a Job Advertisement and delivers the Work Results through the Platform, including using the Services. As specified by the platform
“ Package ” means the Independent Contractor’s Service Description, which the Independent Contractor has described and explained the details of the Work, including the price and delivery timeframe of the Work via the Platform .
“ Order ” means an agreement to hire an independent contractor between the Client and the independent contractor.
“ Work ” means something that is the result of creating work or performing any activity . It is a service provided by an independent contractor as agreed by the customer through the use of the platform service. Fira World
“ Service Fee” means the service fee that the Platform Provider charges to the Freelancer for providing the Platform Services at the rate of 15% , which shall be considered as the fee for providing the intermediary service for hiring freelancers .
“ Personal Data ” means information about an individual which enables the identification of that individual and includes any other information about an individual which enables the identification of that individual, either directly or indirectly.

_{1 . Terms and Conditions}

1.1 The terms and conditions of use of the platform specified herein shall be deemed binding on the platform user immediately upon use of this platform service. If the platform user does not agree to these terms and conditions, the platform user shall
immediately stop using the platform service of the Fira World application .
1.2 The platform user has read and understood the terms and conditions of use of this platform in detail and agrees to accept the terms and conditions of use of the platform before using the platform. The platform user agrees to comply with and be subject to the terms and conditions of use, including acceptance of the
personal data protection policy. (Click to read the details of the Privacy Policy ) As specified by the platform providerThe platform provider may change the terms and conditions of the platform service by displaying new
terms and conditions and notifying platform users without prior notice to platform users .Continued use of the Platform Services after the Platform Provider changes the Terms and Conditions
shall constitute acceptance of the updated Terms and Conditions.
1.3 Platform Provider is the developer of the platform for customers to search/contact for hiring freelancers and /or
independent contractors to post/accept freelance work and / or display freelance work by acting as an intermediary between customers and independent contractors only. The users of the platform must be of legal age or at least 20 years old.
If the user of the Platform is a minor (under 20 years of age) , the consent of the parent or
legal guardian must be obtained and such person must accept these Terms and Conditions and be responsible for
any rights, liabilities or claims resulting from the use or actions of the minor on the Fira World Application or resulting from a dispute over the minor's maturity in a legal transaction in which the minor is involved.

_{2. User account and password}

2.1 Platform users must register for a user account in accordance with the procedures specified by the platform provider in order to be able to use the platform services.
2.2 Platform users must set a password to access the platform and keep their user account password confidential when using the platform. The platform provider will not be responsible for any damages resulting
from the loss of the platform user account and password.

_{3. Use of platform services}

3.1 Customers can choose packages to contact freelancers through the channels specified by the platform provider. Customers can communicate with freelancers through the platform's chat system only after paying the service fee as specified by the platform provider . This payment will allow both parties to communicate to find out more details about the freelance work offered . However, if after communication, both parties cannot reach an agreement, customers can submit a request for a refund of the service fee according to the procedures and conditions specified by the platform provider.
3.2 Customers can agree to hire freelancers by pressing the order button and making payment through the channels specified by the platform provider.
In case the freelancer does not accept the job within 3 days from the date the customer pays, the platform provider will automatically cancel the order and refund the customer's payment back to the credit card used by the customer for payment,
which takes approximately 5-10 days. day
3.3 When the independent contractor delivers the work, the customer must check the work to see if it complies with the terms and conditions of the package that was advertised or the agreements communicated through the platform's chat system. If the work does not comply with the terms and conditions, the customer can reject the work by pressing the "Reject Work" option in the system and stating the reason for rejection. The independent contractor will then be notified to revise the work, which can be revised the number of times specified
in the details of the package that the customer has chosen . When the customer is satisfied with the revised work, press "Accept" in the system, which is considered the end of the work delivery process.
3.4 The customer can cancel the order by themselves at any time before the customer makes the payment, but it is not considered an agreement to hire
a freelancer. In the event that the customer makes the payment through the channel specified by the platform provider, if the freelancer fails to deliver the work or delivers the work that does not comply with the terms and conditions, the package that was advertised for the job, or does not comply
with the agreement mutually agreed upon with the customer via the message channel and has not been resolved according to Section 3.3, the customer can cancel the order by contacting the channel specified by the platform provider, namely 1. Support service channel and 2. Send an email to [email protected] The platform provider will promptly consider conducting an investigation within no more than 7 days.
3.5 When the platform provider has considered the investigation and found that the independent contractor has failed to deliver the work or delivered the work in accordance with the terms and conditions of the package that was advertised or in accordance with the agreement mutually agreed upon with the customer via the message channel, the platform provider will promptly refund the money that the customer has paid back to the credit card that the customer used to pay
, taking approximately 5-10 days.
3.6 Customers may rate their satisfaction and express their opinions on the work or services of independent contractors through the channels specified by the platform provider. The platform provider may display the total satisfaction score and comments or use the total satisfaction score and comments of customers to rank independent contractors for management within the platform

_{4. Customer testimonials}

4.1 The Customer agrees to use the Fira World platform to search for/contact to hire freelancers and /or independent contractors
in accordance with the Platform Service Terms and Conditions, without doing anything that is illegal, induces or encourages to contact to hire outside independent contractors on the platform to avoid service fees.
4.2 The Customer agrees not to disclose Customer information that can be linked or used as a means of contacting or hiring external independent contractors, such as name-surname, telephone number, email, or account name used to contact through other platforms.4.3 The Customer guarantees that it will not use the Fira World platform in any way that is illegal, infringes on the rights of others, or violates public morality, such as fraud, copyright infringement, dissemination of false information, or any other action that may cause damage to other persons or platform providers, etc.

_{5. Platform provider's rights reserved}

5.1 In using the Platform Services, Platform Users may be linked to third parties who are other platform providers. Such actions are solely to facilitate the Platform Users and to support the Platform Provider 's operations and data management systems . In this case The Platform Provider has no control over or rights in any third party platforms that are providers of other platforms and is not responsible for the content of any third party platforms that are linked to the Platform. 5.2 Information, details or content related to posting/accepting freelance work and /or displaying freelance work .
The Fira World Application is provided by an independent contractor who is the owner of the information directly. The Platform Provider only compiles such information, details or content to organize, manage
and display such content on the Fira World Application as a centralized platform for communication between platform users . The Platform Provider There is no legal relationship with the independent contractor as an agent, broker, partner, employer or employee. Therefore, the platform provider Therefore , we do not guarantee that the content, information or works that appear
on the Fira World application are complete, correct , free from defects, damage or any specific benefits. If the content, information or works are inappropriate in any way or cause damage to any person, it will not create any claim, liability or legal obligation to the platform provider.
5.3 Any employment or legal act related to posting/receiving freelance work and / or displaying
freelance work posted on the Fira World application may involve risks, which are the responsibility and obligation of the platform users , who should exercise careful judgment regarding the information and details . or various contents before deciding to take any action for the safety of property and personal rights
5.4 The Platform Provider reserves the right to, at its sole discretion, suspend the account, either temporarily or permanently , as well as
delete the account and register for blacklisting or any other action that the Platform Provider deems appropriate in the event that the Platform User violates the terms and conditions of use of the Fira World Platform.
5.5 The Platform Provider reserves the right to use its discretion to resolve or manage disputes between the Customer and the Independent Contractor as
the Platform Provider deems appropriate and the decision of the Platform Provider shall be final and the Platform User shall accept and comply with it.
5.6​​ In the event that any claim or lawsuit is filed arising from or related to employment or
any legal activity on the Fira World Application, the Platform User shall settle such claim at the Platform User's own risk and expense, and the Platform Provider reserves the right not to be involved
in the settlement of such dispute.
5.7 The Platform Provider shall store the Client's Work delivered by the Independent Contractor for no longer than 90 days from the date the Client accepts the Work. The Platform Provider reserves the right to amend or change the storage period of the Client's Work, with prior notice given to the Client at least 30 days.
5.8 In providing the Platform Services, the Platform Provider may need to access the data of the Platform Users or the data that the Platform Users communicate with each other via messages to help verify, provide assistance and exercise discretion
in resolving or managing disputes. The Platform Provider will exercise caution in accessing the data only in accordance with the criteria of “need to know” and “need to use” facts.The platform provider shall provide appropriate security measures to prevent the loss, access, use, alteration, modification or disclosure of personal data without authorization or inappropriate action.
5.9 The platform provider shall not be liable for any direct or indirect damages or any other damages arising from the use of the platform services or the placing of orders, hiring, delivery or receipt of work between the client and the independent contractor, unless such damage is caused by the intention or gross negligence of the platform provider.
The maximum liability of the platform provider for damages shall not exceed the amount of fees that the platform provider collects from independent contractors for providing the platform services.
